I have a client that is a residential cleaning company. Her ee's drive their own vehicles to jobsites. She had an employee (ee) that left job 1 to go to job 2 and hit another vehicle in the rear causing injuries and physical damage. her insurance had lapsed. Insured pays gas mileage if ee has to drive from one job to another during the day but not for on way to first job site or when leaving last job site. Usually two job sites a day.
Client wants to know if she is responsible for the third party injuries and physical damage.
I tend to think the non-owned coverage would defend her since inbetween job sites but would not if accident happened while on way to first job site in the morning.
What do you guys think?
