    Default Holiday Accident - sitting on railings

    Hi

    I was reading this and wondered if the person/s involved would ever be covered if making an insurance claim:-
    -----------------------------
    A few weeks ago a guy sat on the new rails along the promenade which gave way sustaining injuries warranting admittance to hospital.

    This evening again a person sat on the top rail and it gave way luckily without incident.

    I myself would have thought not as the railings were not being used for thier intended purpose nor are railing designed or intended to be sat upon.

    Yes they should be covered although it sounds like he ever installed the railings may have liability. Sounds like the railings are not properly engineered and are not strong enough.
